FMC Cracks Down on Ocean Carriers: New Rule Shield Shippers

The US Federal Maritime Commission (FMC) has introduced a new rule that will significantly curtail the ability of shipping lines to deny space for booked containers. This move aims to safeguard shippers from unfair practices and restore balance to the shipping industry.

The rule, set to take effect on September 23, comes in response to numerous complaints filed by shippers against carriers for contract breaches. These complaints often centered around carriers prioritizing spot market cargo over contracted shipments, leading to significant financial losses for shippers.

Key provisions of the new rule include:

  • Stricter enforcement: The FMC will have increased authority to penalize carriers for unreasonable refusal to carry contracted cargo.
  • Shipper protection: Shippers will be granted more protection during contract negotiations, reducing the leverage carriers currently hold.
